1. This Agreement constitutes an order for portfolio development services, including the taking of pictures as agreed to by both parties: White Border Photography and contracting party. Unless otherwise specified in writing, it is understood that any and all rights to proofs, final or sample prints, or digital media, thereof (hereinafter referred to as “Images”) shall remain the property of White Border Photography and may be used for advertising, display or any other purposes thought proper by White Border Photography.
2. If White Border Photography cannot perform this Agreement in whole or in part due to fire or other casualty, acts of God or nature or terror, or other cause beyond the control of the parties or due to Photographer’s illness or injury, then Photographer will return all fees to Model but shall have no further liability with respect to this Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of Photographer. Model agrees to limit Photographer’s liability to the amount paid under this contract.
3. It is agreed and understood that no person other than Photographer will be allowed to photograph or take pictures at any time during the session other than a picture of the photographer working for social media purposes.
4. On signing of this Agreement by all parties hereto, the Photographer will reserve the time agreed upon and will not make another reservation for the specific time frame. For this reason, all deposits are non-refundable even if the date is re-scheduled or if the shoot becomes cancelled for any reason by the Model unless other arrangements have been made in writing. If a mutual agreement has been made to reschedule the session, the deposit is transferable to that session for up to 3 months. If a reschedule must happen outside of that 3 month period, that session would be subject to a new deposit and session fee and the former deposit would be non-refundable.
5. White Border Photography and contracting party will allow 4-6 weeks for delivery/mailing of digital images from the date of the photo session unless other written arrangements have been made.
6. Your signature confirms that you have read the details of what is included with your session choice (mini or full). A $150.00 non-refundable retainer is required to book the session. The remaining balance is due at the time of the session. If the session fee is not paid-in-full at the time of the session, no photography will take place.
